JCC JUNIOR CRICKET CHAMPIONSHIP

–INDIA REGISTRATION – TERMS AND CONDITIONS

This page (together with the documents referred to it ) lays down the terms and conditions for the Pre-Registration/Registration by Seven3 Sports Private Limited which will provide the program, the Junior Cricket Championship (the “Program”)as specified in the Pre-Registration/Registration Form to you. Please read the terms and conditions carefully before registration to the Program. You should understand that by registration, you agree to be bound by these terms and conditions.

1. INFORMATION ABOUT US

www.juniorcricketchampionship.com/www.JCCIndia.com (“Site”) is a website operated by Seven 3 Sports Private Limited (S3) (“We”, “Our”, “Us”).

2. YOUR STATUS

By placing a registration, you warrant that:

(a) You are legally capable of entering into binding contracts; and

(b) You are the parent or guardian of the child you are registering; and

(c ) You give full consent for this child to participate in cricket talent hunt, training sessions and/or live match/s conducted by S3 for the Program /Junior Cricket Championship ; and

(d) You allow us to take photos and videos of this child during the Program, and to use such photos and videos for information and/or promotional purposes worldwide and in all types of media.

3. REGISTRATION PROCESS

When you register for a Program the contract between Seven3 Sports Private Limited (S3), the organization running Junior Cricket Championship in India and you will be formed. The “Contract” will be officially formed when we accept your registration/ pre registration.

Please note that places on Program are subject to merit and a fair selection process headed by Senior coaches and a team of cricket experts. The payment taken for a pre-registration is for registering your interest in the Program and the rest of the amount will be payable once we formally accept your registration and enroll you for the Program.

Notice of a confirmed registration will be sent to you by phone, where possible (or alternatively by email) as soon as details of your payment have been processed and entered onto our system.

The Contract will relate only to the Program.

4. PRICE AND PAYMENT

The price of the Program will be as quoted on the Pre-Registration/Registration Form from time to time, except in cases of obvious error.

These prices do not include any relevant taxes, which will be added to the total amount due if applicable.

The prices do not include any transport/accommodation/food etc

Prices are liable to change at any time, but changes will not affect registrations for which you have already paid.

Payment for Program/s can be made by cheque, credit/debit card /online bank transfer/mobile wallets. If you pay using a credit/debit card, your credit/debit card will be charged on the same day we confirm your registration. No cash will be accepted.

5. TOTAL REGISTRATION CHARGES BREAK-UP

Total Registration Charges are Rs. 9999 + GST (Rs. 11799/- All Inclusive).

AT present there is a Special Discounted Offer called, “LOCKDOWN DISCOUNT OFFER” is available to every prospective participant in the following manner:

Avail 33% Discount and Pre – Registration with just Rs. 1000- Only During Lockdown. So the Lockdown Discounted Price shall be Rs. 9999 – less Rs. 3333 (33% discount) = Rs.6666 + GST of Rs. 1200 = Rs 7866 Only.

Balance amount of Rs. 5666 + GST of Rs. 1200 = Rs. 6866 shall be payable post Lockdown is lifted and the date for Talent Hunt is announced.

 You will receive a special JCC branded Jersey along JCC branded Cap with your name personalized on it, absolutely free if you pay the entire registration in advance at the time of Registration.

6. THE PROGRAM

We treat as a priority the safety and well-being of all children attending the Program/Junior Cricket Championship and or any training sessions /matches held by S3 in India. You agree with the rules and code of conduct for players, parents and guardian. Any abuse (physical or verbal) against other players, coaches, staff and members of the public will be treated with ZERO tolerance and will result in the immediate removal from the cricket training sessions and/or match/s conducted by S3.

We reserve the right to remove from a Program any person who is found to be engaged in offensive activity, the bullying of others, disruptive behavior or for any other reason where we consider a person’s behavior is detrimental to the interests or safety of the persons attending a Program. In the event of your removal from a Program for any of these reasons no refund of any fees paid by you shall be made.

We do not provide any conveyance/transport facilities for the child to reach the venue selected for the training sessions/matches, other related activities related to the Program which requires traveling. The child has to make his own travel arrangements and incase of outside the hometown (chosen by the child), all related expenses like accommodation, food.travel etc. shall be the sole responsibility of each child/participant.

7. CANCELLATIONS AND REFUNDS POLICY

Full refund on cancellation, if made within 07 days from the date of registration, provided the session hasn’t started. (The one time pre-registration fee of Rs.500/- which is the processing fee will not be refunded from the total registration charges of Rs. 1000/-. The refunds are applicable to users with Pre-Registration offer of Rs. 1000 as well as Registration with full registration fee. Any GST paid on this account shall also not qualify for refund).

The Program, activities, venues and travel arrangements are subject to change according to weather, venue availability, a satisfactory level of participants or other factors beyond our control. As such, we may cancel or change any Program, should this be necessary for these reasons.

In case a Program is discontinued for unavoidable reasons, we will use reasonable endeavors to restart it  within 3 months of the Program’s closure. Best efforts would be made in this regard.

You are responsible for arranging and paying for suitable insurance to cover any injury or illness to the participant; unfortunately, we cannot provide a refund under these circumstances. For avoidance of doubt, no refund is permitted for participant’s failure to attend the Program.

In all cases refunds of money received from you will usually be made by the same method originally used by you to pay for your Program.

8. LIABILITY

You assume full responsibility for any claims, losses, costs, injuries, articles or liabilities arising out of or related to my child’s participation in the Program’s training sessions and/or match/s. You accept that these activities carry with them some degree of risk both to person and property and knowing this risk, and still desire for your child to participate in these sessions.  In cases of medical emergency or in the unlikely event of an accident/injury , you release, waive and hold harmless S3, including all member companies and its affiliates thereof, coaches, technical staff and directors from any claims, losses, damages or expenses which may arise during the football training sessions and/or match/s.

We are not responsible for indirect losses which happen as a side effect of the main loss or damage even if such losses result from a deliberate breach of these terms that would entitle you to terminate the Contract.

You shall be liable for the cost of any damage to our property or facilities caused by you or by persons under your control.

9. NOTICES

Other than notices of cancellation sent under clause 6, all notices given by you to us must be given to us to Seven3 Sports Private Limited at [email protected][email protected]. Notices will be deemed received and properly served 24 hours after an e-mail is sent, or 3 days after the date of posting of any letter.

10. TRANSFER OF RIGHTS AND OBLIGATIONS

You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without the prior written consent from us.

S3 may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

11. EVENTS OUTSIDE OUR CONTROL

We will not be liable or responsible for any failure to perform, or delay in performance of, any obligations under a Contract that is caused by events outside our reasonable control (“Force Majeure Event”).

A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

(a) Strikes, lock-outs or other industrial action.

(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

(c) Fire, explosion, storm, rain, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster.

(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

(e) Impossibility of the use of public or private telecommunications networks.

(f) The acts, decrees, legislation, regulations or restrictions of any government.

The Program, activities, venues and travel arrangements are subject to change according to weather, venue availability, a satisfactory level of participants other factors beyond our control. As such, we may cancel or change the Program, should this be necessary for these reasons.

Performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which the obligations under the Contract may be performed despite the Force Majeure Event.

12. WAIVER

No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you by notice in writing.

13. SEVERABILITY

If any of these terms or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

14. ENTIRE AGREEMENT

These terms and conditions, the Pre-Registration/Registration Form and any other document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

15. DISCLAIMER – IMPORTANT TO READ

Junior Cricket Championship, the Program is designed specifically for the School going children with a vision to promote Cricket among School going children. JCC is an attempt to improve the School level cricket and provide the School going children a platform where there cricketing and physical fitness skills could be improved. Its also an attempt to engage the school going children towards playing club level cricket and give them an opportunity to be a part of a larger cricket network across the country. By participating in JCC Talent Hunt does not give them an automatic selection into JCC clubs. JCC is owned by S3 and has no association with esteemed International Cricket Council (ICC) and the prestigious Board of Control for Cricket in India(BCCI). JCC draws inspiration from the good work of BCCI and does not stake any claim, direct or indirect, what so ever for children playing in JCC to play for IPL, Indian National Team or national state associations of BCCI. JCC is a humble attempt to engage school going children. The one-time participation charges are to meet the entire arrangement for holding JCC Talent Hunt, producing a comprehensive talent hunt performance report to be shared with every individual participants, training and briefing sessions, and for holding live matches across all its age groups for Round 1 and Round 2. Part of the registration charges will be distributed as prize money to the top 3 winning teams and individual performances as man of the match and man of the season. JCC name resemblance to ICC is pure un-intentional and we re-iterate JCC no association with ICC and clearly state it as no attempt to mislead or misguide.

16. LAW AND JURISDICTION

Contracts for the purchase of Program and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by Indian law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of Gurgaon, Haryana – India.

17. JCC Operating Office

JCC Junior Cricket Championship is owned by Seven3Sports Private Limited with its corporate office at 217, Star Mall, Sector 30, Gurgaon 1122001, Haryana, INDIA. A location pin has also been created on Google Map for general convenience. Seven3Sports Private Limited registered office is situated at 101, Time Square, Sushant Lok I, Gurgaon 122002, Haryana India. Since Seven3Sports Private Limited has already applied for transfer of the registered office and the company shall update the new registered office address as and when available.

18. JCC Clubs, Age Divisions and Live Matches

Seven3Sports Private Limited reserves the rights to change the number of clubs, its structure, format, age divisions and matches at its sole discretion, an any particular season of the JCC or in any year, for any reasons, what’s so ever may be.

19. LAW AND JURISDICTION

Contracts for the purchase of Program and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by Indian law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the courts of Gurgaon, Haryana – India.
